FGA Celebrates SCOTUS Decision to Strike Down Chevron Deference, Ending Unelected Bureaucrats’ Advantage in Court

“D.C. deference is dead. It’s time to revive the American Dream.”

NAPLES, FL–Today, the Foundation for Government Accountability (FGA) celebrates the Supreme Court of the United States’ decision in the case Loper Bright Enterprises, et. al. v. Raimondo (Loper), which endsChevron deference, a legal doctrine that generally requires federal courts to defer to an agency’s interpretation of an ambiguous statute so long as the interpretation is reasonable.  

FGA’s amicus brief in the Loper case argued that courts should be responsible for interpreting the meaning of ambiguous statutes, not the federal agencies that derive their power from them. Today, the Court’s landmark decision validates FGA’s argument and restores constitutional order by ending Chevron deference.

“For nearly 40 years, unelected bureaucrats have used Chevron to expand their power and diminish opportunities to achieve the American Dream. Today, that ends,” said Stewart Whitson, Senior Director of Federal Affairs for the Foundation for Government Accountability. “This starts a new era in Washington, slowing the accelerated growth of the administrative state and paving the way to a return to constitutional order.”

The decision to overrule Chevron rebalances proper separation of powers while promoting consistency and predictability in the application of law. It will simplify litigation, reduce costs, and return responsibility for interpreting statutes to the judiciary, where it belongs.

“This decision will help level the playing field for individuals, workers, and small businesses as Congress works to define a more limited scope of power granted to agencies,” said Whitson. “While this decision is a huge win for the American people, it won’t solve all the problems associated with the administrative state. Now, Congress must respond and reclaim its legislative power from agencies the way the Supreme Court has reclaimed its judicial power.”

“Not only will this decision restore constitutional order, but it will jump-start America’s economy, dramatically reduce red tape, and maximize individual liberty,” added Whitson.
